Please welcome Phil Lindsley of San Diego Elder Law Center and Kimberly McGhee of Black & McGhee Law discussing:
"Can They Still Do That?” ......Staying Safe: The Law and Mental Capacity Determinations
In California legal capacity is not determined solely by diagnosis or condition. These are only the starting points. The law then asks “Yes, but can they understand this.” The answer comes from questions about the person’s understanding and appreciation of the specific task at hand. Fortunately, the law is clear on the elements of that analysis. In this presentation, we will discuss:
Overview of the Law
Conservatorships and alternatives for substitute judgement
Planning for Incapacity
How to protect yourself as a professional
Tips from the trenches

Non-Profit Spotlight:
Brad Thorp and Haley London of The Mitchell Thorp Foundation
The Mitchell Thorp Foundation was founded in honor of Mitchell Thorp, whose courageous battle with an undiagnosed rare disease inspired a mission to bring hope and support to families facing similar hardships. Every day, families come to the Mitchell Thorp Foundation overwhelmed and afraid as their child faces cancer, a rare disease, or a critical medical condition and often, they have nowhere else to turn. Most families lose over half their income while struggling to afford care, housing, and food. With 15 million children facing rare or chronic illnesses—and 1 in 285 diagnosed with cancer before age 20 the need for compassionate support has never been greater.
Mitchell Thorp Foundation meets these urgent needs by restoring hope, easing financial strain, and helping families stay together during their hardest battles. What sets the Mitchell Thorp Foundation apart is our unwavering commitment to transparency, impact, and care. We proudly partner with 16 leading children’s hospitals across the country to identify and support the children and families who need us most.
Thanks to generous sponsors who cover our operating expenses, 100% of donations go directly to life-changing programs for families in crisis.
